Sensirion wins patent infringement lawsuit

Sensirion AG has successfully sued a competitor for infringement of one of its patents covering particulate matter sensors. With the decision dated 07/25/2023, Düsseldorf District Court determined that certain particulate matter sensors of the Chinese manufacturer Cubic Sensor and Instrument Co., Ltd based in Wuhan infringe Sensirion’s patent EP 2 145 171.

In particular, Düsseldorf District Court ruled on the following models:

 

•             PM2008M-M and –API

•             PM 2006 MD

•             PM 2009

•             PM 2012 SE-A and SE-B

•             PM 2016

•             PM 2105 M and S

•             PM 2107

 

The defendant in this proceeding, Acal Bfi Germany GmbH, was sentenced by the District Court of Düsseldorf to cease and desist, destroy the goods, provide information, and pay damages due to the distribution of these sensors in Germany. In the meantime, the decision was appealed. Acal Bfi Germany GmbH has filed a nullity action with the Federal Patent Court against the German part of the European patent.
